Service Agreement

CONTRACT:

This contract will begin on the date it is signed and the non-refundable / non-transferrable deposit is received. This agreement will remain in effect until the event date listed. Services requested after the event date will require a new agreement. The Planner and the client acknowledge the Planner is acting as an IndependentContractor.The Planner agrees that all client information received (i.e. financial or personal affairs) will be treated in full confidence and will not be revealed to any other persons or organizations.

EXPECTATIONS FOR ALL SERVICES:

We prides ourselves on creating meaningful events and providing exceptional customer service throughout your event journey. We share your desire to have a sustainable, enjoyable, and celebratory day. Services will be in accordance to the service description selected in your invoice. Services are designed for the wedding day only. For surrounding wedding related events, guidance is included however planning efforts may require additional planning sessions for fulfillment.All services include:

  • (1) Professional, experienced Lead Planner from the Pomegranate Occasions team.We do everything possible to keep an assigned planner with you throughout the wedding planning journey however if circumstances arise, we may need to re-assign planners.

  • Consultation sessions based on your selected service type.

  • Communications and confirmations with vendors.

  • Personal Decor Set Up within the guidelines of our "Personal Decor Scope" (located below).

  • Processional Aisle Cue Coordination of Wedding Party.

  • Communicating and overseeing announcements and transitions of event flow with all vendors andguests.

  • Guest management including attending to your guest needs as they arise to the best of our ability.

  • Repurposing floral or decor within reason from ceremony to reception. Additional staffing may berequired for large or multiple items and dependent on timeline needs.

  • Distribution of day-of payments and gratuities.

  • Arranging for gift transportation at end of evening. (see Event Strike terms and conditions below)

Out of Scope Services:

  • Booking Airline Travel, Vehicle Rentals & Hotel or VRBO Accommodations.Guidance on hotels and VRBO's is included.

  • Addressing or mailing Wedding Stationary (post or email).Guidance on timeline for sending wedding invites and communications is included.

  • RSVP management - Clients are responsible for guest communications.

  • Personal Attire purchase(s). Attire guidance is included.

  • Post-Wedding Day vendor concerns or disputes are between the client and the vendor.

FOR "DAY OF" SERVICE CLIENTS: Before the first consultation session clients are required to:

  • Finalize and send vendor invoices and contracts for your venue, photographers, videography, transportation, florals, etc.

  • Menu, bar, and dessert selections

  • Complete your Day Of questionnaire provided by Pomegranate Occasions (sent 60 days from your wedding date

If the above required tasks are not completed before your first consultation session, please notifyPomegranate Occasions at least 8 weeks in advance of your wedding date. Your Lead Wedding Planner may require you to add on additional consultation sessions (consultation sessions at a rate of $150/hr) to ensure your wedding day runs efficiently.

CONTROL & DIRECTION:

We wish we could control the weather, traffic, guest relations, vendor or venue shortcomings, however we can only control the way we manage these unforeseen circumstances. We advise and guide in a decisive manner with the information we have and based on our in-depth experience.Your trust in our ability to execute and executive decide is imperative to our service agreement and leads to the best outcomes.

We take our direction from the Bride(s) &/or Groom(s) named in this agreement ONLY. Consultation Sessions and Wedding Day direction must include or be direct from the Bride and / or Groom only. Additional friend and family members may attend up to (2) consultation sessions in your package. Please see more on our FAQ page regarding our commitment to your event wishes.

SET UP AND STRIKE:

PERSONAL DECOR: the following decor items are included in the set up and strike in all of our services:

Welcome Station | Wedding Favors: Pre-assembled Welcome Signage & Easel, up to 100 Pre-assembled Wedding Favors

Guest Sign In / Gifts Station: Card box and/or Gift signage, Guest Sign-In items limited to one item and pens.

Ceremony: Signage, programs in a basket, unity celebration items. Items for individual chairs may require an assistant.

Reception: Pre-assembled Table Seating Chart & Easel, Bride & Groom Table DecorIndividual name cards, menu cards or specific individual tokens require an assistant. DIY Table-centerpieces require an assistant.

Memory Station: up to 10 Personal Photo in Frames Of Couple or Loved Ones

Dessert: Dessert signage, Cake Topper, Serving items

Restroom touches: preassembled in a basket.

The above personal decor items require 3 hours prior to ceremony for set up and 1 hour for strike.Personal decor items beyond the list above such as Name Cards, additional decor stations, items requiring assembly require a wedding day assistant at ($60/hour with a 2 hour minimum) to adequately accommodate for set up.If you have a specific layout for your personal decor, we require a mock-up photo to set up specificto your vision.

FLORAL STRIKE: is the removal of all floral from the venue.

Pomegranate Occasions requires an assistant to aid in the floral and vase removal for floral packages above $2,000 if floral strike is not a part of your Florist Contract. Note: also consider donating your florals to Petal Kindness.

FOOD & BEVERAGE: All food and beverage debris must be removed by your Catering and/or Beverage Vendors.

If these options are not available through your Catering or Beverage vendors we require additional staffing to maintain the food and beverage debris and clean up with a 1:20 catering staff to guest ratio for optimal catering service expectations and 1:50 bartender to guest ratio for optimal beverage service expectations.

MUSIC / AV: AV or music related needs for ceremony or reception must be the responsibility of theDJ/Band or a trusted wedding guest.

PHOTO RELEASE: Pomegranate Occasions reserves the right to take and/or purchase photographs of the services we produce to use for business marketing purposes.

COMMUNICATIONS:

All planners are professionals who operate by our core values of Kindness, Honesty, and Respect. Client communications must display mutual respect and kindness and be adhered to at all times.Rudeness, bullying, or disrespect will result in early termination of the contract.

Aisle Planner:Pomegranate Occasions utilizes a cloud-based software for documenting, organizing, and planning your event. Clients are expected to have familiarity with cloud-based collaboration and a willingness to engage within the planning portal. If the client is unwilling or does not have the resources to collaborate online, this will result in the early termination of the contract.

Consultation Sessions:The client is responsible for schedule their consultation sessions included in each package. Planners calendars are kept up-to-date for optimal convenience.Consultation Sessions must be with the couple (Bride and/or Groom) only. Additional friend and/or family member may attend up to (2) sessions in your wedding service package.Emails,

AP Communications, Phone Calls & Text Messages: We strive to respond to all non-critical communications within 72 hours and critical emails within 48 hours of receipt.Non-critical is defined as questions or concerns about your event that occur outside of 30 days from your event day. Critical is defined as questions or concerns within 30 days of your event date.Emails and AP Communications are preferred for event planning. Phone Calls and TextMessages are preferred within 14 days of your event date.Please note our hours vary due to the nature of our working schedules.

COMPENSATION

For services over $1,000, Payments are:

  • 50% - non-refundable / non-transferrable deposit to secure your event date.

  • Balance due 30 days from your event date.

Credit cards are required to be on file. Service balance will be charged if cancellation occurs within 14days of event date. If an invoice is not paid within 10 business days of the due date the card on file willbe charged.

For services $1,000 or less, full payment must be made at the time of booking.

Potential Additional Charges:

Meal - a meal must be provided if working over 4 consecutive hours, or will be invoiced for $50.

Travel - travel over 50 miles or 50 minutes from your Planners home office will be invoiced at $60per hour. During the peak summer months (June - August), we plan an additional 1 hour of travel time to account for the summer traffic.

Air Quality - if the client chooses to have an outdoor event when the Air Quality Index (AQI) is at or above 'Unhealthy' levels, an additional $300 will be added for performing services in unhealthy or hazardous conditions.

Excessive Clean Up - If the planner performs any of the following services in compliance with your venue contract there is an additional charge:

  • Clean up of vomit or toilet related issues - $250.

  • Removal of left behind personal belongings or decor not accounted for - $100.

  • Excessive trash removal (ie. flower petals, glow sticks, confetti, broken glass, etc.) - $50.

We perform these activities based on our executive judgement to save you the liability and loss of your venue deposit.

"Add On's" or event related expenses - will be invoiced separately. Examples include: Additional planner hours outside of the contracted package amount. Additional hours above the contracted amount are $150 / hour. Services performed before 8 am or after 11pm - $200/hour.

Assistant Required if:

  • a non-professional (no business license, service website, liability contract) floral, catering, or bartending vendor are providing services on your wedding day, a minimum of one assistant or staffing will be required for the event duration.

  • personal decor exceeds the items included in our service agreement.

  • the timeline dictates that a planner needs to be in two places at the same time, or your event has two separate locations requiring ground transportations.

CANCELLATIONS OR POSTPONEMENTS

We understand unforeseen circumstances may arise. We strive to accommodate circumstances to the best of our abilities. To maintain the quality of our services and ensure fair business practices, we have established the following cancellation policy: 

Client-initiated Cancellation: The client reserves the right to cancel this Agreement for any reason. To initiate the cancellation process, the client must send a written notice to pomegranateoccasions@gmail.com. 

Refunds for Cancellation: In the event of cancellation by the client within the allowed timeframe(up to 30 days before the event date), refunds will be processed based on the amount paid, minus the hours already invested in event planning at the rate of $135 per hour, excluding the non-refundable deposit. The non-refundable deposit is an essential part of securing our services for your event and will not be eligible for any refunds, regardless of the cancellation date or changes in services. 

Cancellation within 30 Days: Cancellations made within 30 days from the event date will not be eligible for any refunds. We commit significant resources and efforts towards organizing the eventas the date approaches, making it challenging to fill the time slot with another event.

Postponed or Rescheduled Events: In case the client decides to postpone or reschedule theevent, we do our best to accommodate the new date, subject to availability. However, please beaware that the total price for the rescheduled event may be subject to a 15% rescheduling fee.

Our cancellation policy has been designed to be fair to both parties while recognizing the commitmentand effort involved in event planning. We encourage clients to inform us as soon as possible if anychanges or cancellations are anticipated, as this will help us better accommodate your needs and offerthe best possible service. If you have any questions or concerns regarding this policy, please do nothesitate to contact us at any time.

Client assumes responsibility for any and all reasonable, documented collection and court costs andlegal fees incurred in the event that enforcement of this contract becomes necessary and PomegranateOccasions is the prevailing party in any such court proceeding.

FORCE MAJEURE

Neither Party will be liable for any failure or delay in performing an obligation under this Agreement thatis due to any of the following causes, to the extent beyond its reasonable control: acts of God, accident,riots, war, terrorist act, epidemic, pandemic, quarantine, civil commotion, breakdown of communicationfacilities, breakdown of web host, breakdown of internet service provider, natural catastrophes,governmental acts or omissions, changes in laws or regulations, national strikes, fire, explosion,generalized lack of availability of raw materials or energy.

Force Majeure shall not include (a) financial distress nor the inability of either party to make a profit oravoid a financial loss, (b) changes in market prices or conditions, or (c) a party's financial inability toperform its obligations hereunder.

In the event Pomegranate Occasions cannot perform according to the contract signed due tocircumstances beyond it's control, all deposits or other monies paid will be applied to a future dateagreed upon by Pomegranate Occasions and client, not to exceed one year of the original date.

The undersigned acknowledge that they have read this agreement and agree to the terms and conditions set forth above.

We advise and guide in a decisive manner with the information we have and based on our in-depth experience.Your trust in our ability to execute and executive decide is imperative to our service agreement and leads to the best outcomes.

We take our direction from the Bride(s) &/or Groom(s) named in this agreement ONLY. Consultation Sessions and Wedding Day direction must include or be direct from the Bride and / or Groom only. Additional friend and family members may attend up to (2) consultation sessions in your package. Please see more on our FAQ page regarding our commitment to your event wishes.

SET UP AND STRIKE:

PERSONAL DECOR: the following decor items are included in the set up and strike in all of our services:

Welcome Station | Wedding Favors: Pre-assembled Welcome Signage & Easel, up to 100 Pre-assembled Wedding Favors

Guest Sign In / Gifts Station: Card box and/or Gift signage, Guest Sign-In items limited to one item and pens.

Ceremony: Signage, programs in a basket, unity celebration items. Items for individual chairs may require an assistant.

Reception: Pre-assembled Table Seating Chart & Easel, Bride & Groom Table DecorIndividual name cards, menu cards or specific individual tokens require an assistant. DIY Table-centerpieces require an assistant.

Memory Station: up to 10 Personal Photo in Frames Of Couple or Loved Ones

Dessert: Dessert signage, Cake Topper, Serving items

Restroom touches: preassembled in a basket.

The above personal decor items require 3 hours prior to ceremony for set up and 1 hour for strike.Personal decor items beyond the list above such as Name Cards, additional decor stations, items requiring assembly require a wedding day assistant at ($60/hour with a 2 hour minimum) to adequately accommodate for set up.If you have a specific layout for your personal decor, we require a mock-up photo to set up specificto your vision.

FLORAL STRIKE: is the removal of all floral from the venue.

Pomegranate Occasions requires an assistant to aid in the floral and vase removal for floral packages above $2,000 if floral strike is not a part of your Florist Contract. Note: also consider donating your florals to Petal Kindness.

FOOD & BEVERAGE: All food and beverage debris must be removed by your Catering and/or Beverage Vendors.

If these options are not available through your Catering or Beverage vendors we require additional staffing to maintain the food and beverage debris and clean up with a 1:20 catering staff to guest ratio for optimal catering service expectations and 1:50 bartender to guest ratio for optimal beverage service expectations.

MUSIC / AV: AV or music related needs for ceremony or reception must be the responsibility of theDJ/Band or a trusted wedding guest.

PHOTO RELEASE: Pomegranate Occasions reserves the right to take and/or purchase photographs of the services we produce to use for business marketing purposes.

COMMUNICATIONS:

All planners are professionals who operate by our core values of Kindness, Honesty, and Respect. Client communications must display mutual respect and kindness and be adhered to at all times.Rudeness, bullying, or disrespect will result in early termination of the contract.

Aisle Planner:Pomegranate Occasions utilizes a cloud-based software for documenting, organizing, and planning your event. Clients are expected to have familiarity with cloud-based collaboration and a willingness to engage within the planning portal. If the client is unwilling or does not have the resources to collaborate online, this will result in the early termination of the contract.

Consultation Sessions:The client is responsible for schedule their consultation sessions included in each package. Planners calendars are kept up-to-date for optimal convenience.Consultation Sessions must be with the couple (Bride and/or Groom) only. Additional friend and/or family member may attend up to (2) sessions in your wedding service package.Emails,

AP Communications, Phone Calls & Text Messages: We strive to respond to all non-critical communications within 72 hours and critical emails within 48 hours of receipt.Non-critical is defined as questions or concerns about your event that occur outside of 30 days from your event day. Critical is defined as questions or concerns within 30 days of your event date.Emails and AP Communications are preferred for event planning. Phone Calls and TextMessages are preferred within 14 days of your event date.Please note our hours vary due to the nature of our working schedules.

COMPENSATION

For services over $1,000, Payments are:

  • 50% - non-refundable / non-transferrable deposit to secure your event date.

  • Balance due 30 days from your event date.

Credit cards are required to be on file. Service balance will be charged if cancellation occurs within 14days of event date. If an invoice is not paid within 10 business days of the due date the card on file willbe charged.

For services $1,000 or less, full payment must be made at the time of booking.

Potential Additional Charges:

Meal - a meal must be provided if working over 4 consecutive hours, or will be invoiced for $50.

Travel - travel over 50 miles or 50 minutes from your Planners home office will be invoiced at $60per hour. During the peak summer months (June - August), we plan an additional 1 hour of travel time to account for the summer traffic.

Air Quality - if the client chooses to have an outdoor event when the Air Quality Index (AQI) is at or above 'Unhealthy' levels, an additional $300 will be added for performing services in unhealthy or hazardous conditions.

Excessive Clean Up - If the planner performs any of the following services in compliance with your venue contract there is an additional charge:

  • Clean up of vomit or toilet related issues - $250.

  • Removal of left behind personal belongings or decor not accounted for - $100.

  • Excessive trash removal (ie. flower petals, glow sticks, confetti, broken glass, etc.) - $50.

We perform these activities based on our executive judgement to save you the liability and loss of your venue deposit.

"Add On's" or event related expenses - will be invoiced separately. Examples include: Additional planner hours outside of the contracted package amount. Additional hours above the contracted amount are $150 / hour. Services performed before 8 am or after 11pm - $200/hour.

Assistant Required if:

  • a non-professional (no business license, service website, liability contract) floral, catering, or bartending vendor are providing services on your wedding day, a minimum of one assistant or staffing will be required for the event duration.

  • personal decor exceeds the items included in our service agreement.

  • the timeline dictates that a planner needs to be in two places at the same time, or your event has two separate locations requiring ground transportations.

CANCELLATIONS OR POSTPONEMENTS

We understand unforeseen circumstances may arise. We strive to accommodate circumstances to the best of our abilities. To maintain the quality of our services and ensure fair business practices, we have established the following cancellation policy: 

Client-initiated Cancellation: The client reserves the right to cancel this Agreement for any reason. To initiate the cancellation process, the client must send a written notice to pomegranateoccasions@gmail.com. 

Refunds for Cancellation: In the event of cancellation by the client within the allowed timeframe(up to 30 days before the event date), refunds will be processed based on the amount paid, minus the hours already invested in event planning at the rate of $135 per hour, excluding the non-refundable deposit. The non-refundable deposit is an essential part of securing our services for your event and will not be eligible for any refunds, regardless of the cancellation date or changes in services. 

Cancellation within 30 Days: Cancellations made within 30 days from the event date will not be eligible for any refunds. We commit significant resources and efforts towards organizing the eventas the date approaches, making it challenging to fill the time slot with another event.

Postponed or Rescheduled Events: In case the client decides to postpone or reschedule theevent, we do our best to accommodate the new date, subject to availability. However, please beaware that the total price for the rescheduled event may be subject to a 15% rescheduling fee.

Our cancellation policy has been designed to be fair to both parties while recognizing the commitmentand effort involved in event planning. We encourage clients to inform us as soon as possible if anychanges or cancellations are anticipated, as this will help us better accommodate your needs and offerthe best possible service. Client assumes responsibility for any and all reasonable, documented collection and court costs andlegal fees incurred in the event that enforcement of this contract becomes necessary and PomegranateOccasions is the prevailing party in any such court proceeding.

FORCE MAJEURE

Neither Party will be liable for any failure or delay in performing an obligation under this Agreement thatis due to any of the following causes, to the extent beyond its reasonable control: acts of God, accident,riots, war, terrorist act, epidemic, pandemic, quarantine, civil commotion, breakdown of communicationfacilities, breakdown of web host, breakdown of internet service provider, natural catastrophes,governmental acts or omissions, changes in laws or regulations, national strikes, fire, explosion,generalized lack of availability of raw materials or energy.

Force Majeure shall not include (a) financial distress nor the inability of either party to make a profit oravoid a financial loss, (b) changes in market prices or conditions, or (c) a party's financial inability toperform its obligations hereunder.

In the event Pomegranate Occasions cannot perform according to the contract signed due tocircumstances beyond it's control, all deposits or other monies paid will be applied to a future dateagreed upon by Pomegranate Occasions and client, not to exceed one year of the original date.

The undersigned acknowledge that they have read this agreement and agree to the terms and conditions set forth above.
